Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website at www.phebert.dev (the “Site”) and the web applications hosted on subdomains of phebert.dev (the “Apps,” and together with the Site, the “Services”), operated by Peter Hebert (“I,” “me,” or “my”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

2. Nature of the Services

The Services are independent, non-commercial software projects provided free of charge. Some Apps are open to everyone; others are available by invitation. They involve no subscriptions, purchases, or transactions.

3. Accounts and Eligibility

Some Apps require you to sign in with a Google account so the App can identify you. You are responsible for activity that occurs under your account. Access is at my discretion: I may grant, limit, suspend, or revoke access to any App, for any account, at any time, with or without notice. You must be at least 13 years old to use the Apps.

Some Apps may let you create or upload content (notes, lists, photos, and the like). You retain ownership of your content. By using an App, you grant me the limited rights needed to store, display, and process that content solely to operate the App for you and the people you share it with. You can ask for your content to be deleted at any time by contacting me.

6. Intellectual Property

The Services, including their design, code, text, and graphics (but excluding your content), are the property of Peter Hebert or their respective licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works of the Services without prior written consent.

7. Third-Party Services

The Services rely on third-party services, including Google (for sign-in) and Cloudflare (for hosting). Your use of those services is governed by their own terms and policies, which I do not control. The Site may also link to third-party websites; I am not responsible for their content or practices.

8. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL WARRANTIES ARE DISCLAIMED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THESE ARE HOBBY PROJECTS: I DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT DATA WILL NOT BE LOST. PLEASE KEEP YOUR OWN COPIES OF ANYTHING IMPORTANT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PETER HEBERT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT I HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

You may stop using the Services at any time. I may suspend or terminate your access to the Services at any time, for any reason, with or without notice. Upon termination, sections of these Terms that by their nature should survive (including Sections 6, 8, and 9) will survive.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction and venue of such courts.

12. Changes to These Terms

I may modify these Terms from time to time. If a revision is material, I will provide reasonable notice, typically by posting a notice on the Site or within the Apps. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
